Notice of Privacy Practices
Proposed clinical privacy notice for Chang Encinitas Medical PC dba RegenexMed. Draft for practice review; not yet an effective patient notice. The practice must confirm its covered-entity status, privacy contact, effective date and applicable California protections before adoption.
Please review this notice carefully
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Protected health information identifies you and relates to your health, healthcare or payment for care. This proposed notice concerns that information, separately from the website Privacy Policy.
Treatment, payment and healthcare operations
Subject to applicable law, we may use and disclose health information to provide and coordinate care, obtain payment and run the practice. Examples include sharing relevant information with a treating clinician, processing payment and reviewing quality of care.
Service providers that handle protected information on the practice’s behalf must meet applicable privacy requirements, including business-associate agreements where required. Appointment reminders and treatment communications are subject to your communication preferences and applicable law.
Other permitted or required disclosures
The law allows or requires certain disclosures for public health and safety, reporting abuse or neglect, health oversight, research with required protections, organ donation, coroners or funeral directors, workers’ compensation, and certain government functions. Requests from courts, law enforcement or other authorities must meet the applicable legal conditions; a request alone does not make every disclosure permissible.
Where California or other applicable law provides greater protection, those limits apply. Additional California protections and record-specific limits must be reflected in the effective notice.
Your choices and written authorization
You may tell us your preferences about sharing information with people involved in your care or in disaster-relief circumstances. If you cannot express a preference, permitted disclosures may be made using professional judgment and the applicable legal limits.
Uses for marketing, sales of protected health information and most disclosures of psychotherapy notes require written authorization except where law permits otherwise. Other uses not covered by this notice also require authorization. You may revoke an authorization in writing, except to the extent action has already been taken in reliance on it.
Substance use disorder records
If we receive substance use disorder patient records protected by 42 CFR Part 2, those records cannot be used or disclosed in investigations or proceedings against you without your written consent or the required court order and subpoena. Additional Part 2 protections may apply.
If Part 2 information is used for fundraising communications, advance clear notice and a choice about receiving those communications are required. This provision does not state that RegenexMed operates a substance use treatment or fundraising program.
Your rights
You may request access to or a copy of your record, ask to correct incomplete or inaccurate information, request confidential communications, ask for limits on uses and disclosures, request an accounting of certain disclosures, obtain a paper copy of the notice and act through an authorized personal representative.
HIPAA generally requires action on an access request within 30 days, with a limited extension when permitted. More protective California access rules may apply. Reasonable cost-based fees may be permitted for copies. A request to amend may be denied with a written explanation as required by law.
The practice is not required to agree to every requested restriction. It must honor an applicable request not to disclose a fully self-paid service to a health plan for payment or healthcare operations unless disclosure is required by law. Ask the practice how to submit a request securely.
You may request an accounting of certain disclosures during the preceding six years. The accounting does not include every treatment, payment or healthcare-operations disclosure. One accounting in a 12-month period is generally free; additional accountings may carry a reasonable cost-based fee.
You may obtain a paper copy of the effective notice even if you receive it electronically. An authorized personal representative may exercise rights on your behalf after authority is verified. Reasonable requests for confidential communications must be accommodated.
If an amendment request is denied, the practice must explain the decision in writing as required by law. HIPAA generally provides a 60-day response period, subject to a permitted extension. A denied request does not remove your other applicable rights.
Responsibilities and changes
A covered practice must protect the privacy of protected health information, provide its notice, follow the notice currently in effect and notify affected people of breaches when required. Information lawfully disclosed to a recipient may be redisclosed and may no longer be protected by HIPAA; other applicable protections may still apply.
If the practice changes its effective notice, the revised terms may apply to information it already holds. The effective version must be available on request and through the practice’s required notice channels.
